Basic Decisions:
Decision 1787 - AH in the Haverford SD
Elementary School 
Read for overview on requirement to establish PLEP, Burden of Proof issues, and the need for timely implementation.  Comp ed awarded on a per-day basis once it became known that the GIEP is inappropriate.  Note:  Overt tape recording of GIEP meetings is okay, absent an established District policy against the practice.

Decision 1737 -  DD in North Penn SD
Elementary - Middle School
Good overview to read.  PLEP discussed along with inclusion of a student peer in the Gifted IEP. One key point is that Parent approval of a Teacher's actions does not, by itself,  make a Gifted IEP appropriate.
The Appeals Panel of the Office of Dispute Resolution interprets Chapter 16 and Special Education in general.  Theirs is the relevant perspective on issues related to your child's immediate Gifted Ed and/or Special Ed experience.  If you are dissatisfied with your child's gifted or special education, and considering saying so at a meeting, reading certain decisions can help you frame your thinking.  These address common issues:

Decision 1156
Middle School
Pull-out only not sufficient, time frame for evaluations is student-driven, not district.  Good for parents in 'pull-out only' districts to read.
Decision 1407
High School
District thinks gifted HS student should receive gifted ed services during her lunch.
Parent disagrees.  Parent is right. Districts, at times, do dumb things and, until the regs change,  parents have to take action.
